Plain terms for a plain tool.

These terms are an agreement between you and MentorGrad ("we"), the maker of mote. They govern your use of the mote application and the motemd.com website. The bold sentence at the start of each section is a summary; the paragraph below it is what binds.

1. License grant

You buy a perpetual license to use mote, not a subscription. Subject to these terms and payment of the applicable fee, MentorGrad grants you a non-exclusive, non-transferable, perpetual license to install and use the major version of mote current at purchase (for example 1.x) and every release of that major version. A Personal license is for one person and may be activated on up to three devices that you own or control; it may not be shared between people. A Team license is per named seat, three devices per seat, and is managed by the address it was bought with. Any license may be used for commercial work.

2. Trial

The trial is 14 days, full-featured, and then read-only. You may evaluate mote for 14 days from first launch without charge. After that, editing functions are disabled until a license key is entered; opening, reading, searching, and exporting files remain available. Circumventing the trial timer is a breach of these terms. The public beta has no trial period.

3. Updates and major versions

Every release within your major version is included. A new major version (for example 2.0) is a separate purchase, offered to existing owners at a discount and never installed automatically. If you bought within the 90 days before a new major version was released, your license is raised to that major version at no charge. Minor and patch releases inside your major version are free for as long as we publish them; we do not promise a fixed number or schedule of releases.

4. Purchases, taxes, refunds

Paddle sells it worldwide, we sell it in Korea, and refunds are 14 days, no questions. Outside Korea, purchases are processed by Paddle.com Market Ltd. as merchant of record, whose buyer terms also apply; Paddle issues the receipt and the tax invoice. Tax is shown at checkout for your country; the price shown there is the price you pay. In Korea, you buy from MentorGrad directly and pay in KRW through Toss Payments; prices shown there include 10% VAT, and we issue the receipt.

You may request a full refund within 14 days of purchase for any reason. The details — how to ask, how long the money takes, and what happens to your key — are in the Refund policy, which forms part of these terms. Nothing here limits your statutory rights: the 14-day right of withdrawal for consumers in the EU, EEA and UK, and the 7-day right of withdrawal under the Act on Consumer Protection in Electronic Commerce for consumers in Korea, apply in full. Launch and promotional prices apply only while the pricing page shows them.

5. Discount codes and education pricing

Education codes are for the person they were issued to. Discount codes are applied at checkout and cannot be combined. Education and non-profit codes are issued to one named person after we check the institutional address, are valid for 30 days, may be used once, and buy a Personal license under the same terms as any other. Providing false information to obtain a code, or transferring a code or the license bought with it, entitles us to cancel the code and revoke the license without refund.

6. Restrictions

Don't resell it, crack it, share your key, or pass it off as yours. You may not sublicense, rent, lease, or resell mote or a license key; publish or share a license key beyond the people it is licensed to; remove, alter, or circumvent license enforcement or the trial; reverse engineer the software except where the law permits it; make automated or bulk requests to our activation and update servers; or use mote's name or marks to suggest endorsement. Keys found being distributed publicly are revoked, and we may refuse further sales to the same person.

7. Your files

Your files are yours and never leave your machine through mote. We claim no rights in any content you create or edit. mote does not transmit file contents. Because mote writes directly to your files, you are responsible for keeping backups; see section 9.

8. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these terms.

9. Warranty and liability

We work hard to keep your bytes exact, but the software is provided as is. To the maximum extent permitted by law, mote is provided "as is" without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that it is error-free. Our total liability arising from these terms or your use of mote is limited to the amount you paid for your license in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for death, personal injury, fraud, or intent or gross negligence on our part, or your statutory rights as a consumer.

10. Termination

Your license ends automatically if you materially breach these terms and do not cure the breach within 14 days of notice. On termination you must stop using mote and delete your copies. Sections 7 through 13 survive.

11. Changes to these terms

We may revise these terms for future versions. The terms in force when you purchased continue to apply to that version. Material changes will be summarized on this page, dated, and noted in the release notes at least 14 days before they take effect.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Korea, and disputes are subject to the exclusive jurisdiction of the courts of Seoul, except that consumers retain the protection of mandatory law in their country of residence. If something goes wrong, write to us first; most issues are settled by mail within a few days. Consumers in Korea may also apply to the Consumer Dispute Settlement Commission of the Korea Consumer Agency, and consumers in the EU may use the European Commission's online dispute resolution platform.
